Married-Filing-Joint Requires Spouse Have SSN or ITIN

International marriages between an American and foreign spouse are unique and interesting relationships. In the beginning, they can also be challenging if immigration and taxes are part of the process. Newlyweds can avoid the stress of applying for an ITIN and filing a joint tax return by understanding their options, learning about the process, and relying on guidance of an IRS approved Certified Acceptance Agent.

What is an ITIN?

An Individual Taxpayer Identification Number (ITIN) is issued by the IRS to individuals who are not eligible for a Social Security Number (SSN), often due to pending immigration status. It is used by foreign spouses and others who need to file a tax return or elect to file jointly with their American spouse.

Who is a CAA?

A Certified Acceptance Agent (CAA) is authorized by the IRS to help individuals apply for an ITIN. CAAs verify identity documents like passports and submit Form W-7 on your behalf, so you don’t need to mail originals to the IRS. This makes working with a CAA faster, safer, and more convenient than dealing with the IRS directly.

Authenticate Passport

The most common method for authenticating an ITIN applicants’ foreign status and identity is with a valid passport. The original passport, not a copy, needs to be inspected either in-person or during a video conference before Form W-7 (COA) can be signed by the reviewer.

The budget-friendly option is to work directly with the IRS. You can schedule an appointment by contacting a Taxpayer Assistance Center with ITIN services or mail your passport along with your ITIN Application Package. These services are offered at no cost, but appointments are hard to find, and you can expect to wait several weeks. As for mailing such important documents, it’s downright terrifying for most.

The fee-based option is to engage the services of a Certified Acceptance Agent (CAA).

The preferred option is to engage an experienced tax professional, that’s also a CAA, who has the capability to provide these services remotely. This is what we do and our combined services fulfill all, not just part, of your federal tax reporting needs. Choose to meet in-person or virtually at our office in Huntington Beach, California, where passports are kept safe and promptly returned via FedEx.

Our Process

Our ITIN application service helps non-U.S. residents obtain an Individual Taxpayer Identification Number (ITIN) without the hassle of dealing with the IRS directly. As a Certified Acceptance Agent (CAA) in Huntington Beach, we handle the entire process, from verifying documents to submitting the application, so you don’t have to visit the IRS office.

We also prepare your federal tax return as part of the application, making sure your submission meets IRS requirements. Whether you’re applying for the first time or renewing, we take care of everything from start to finish.

Determine Eligibility

Before the paperwork starts, we confirm the applicant is eligible for an ITIN and ineligible for a Social Security Number. Also, we will start reviewing your General Tax Organizer and tax documents so we’re ready with any clarifying questions. Once we understand the scope of you your filing requirements, we’ll present you with a fixed-fee invoice to prepare the ITIN package.

Prepare ITIN Package

Once you’ve fully engaged our services, we get to work. We start by concurrently preparing IRS Form W-7, Form W-7 (COA), a Married-Filing-Joint Declaration, and your federal and state income tax returns.

To be successful, an ITIN Application must include all these separately prepared documents, printed to paper, organized correctly, and mailed to the IRS. Managing all this paperwork is prone to error but we’ve been doing this since 2018. When it comes to ITIN Applications, experience counts.

Verify Passport

During our initial meeting, we’ll discuss the best method for authenticating your passport. If you live nearby, this may include a follow-up appointment where you bring your passport to our office for same-day authentication and return.

For those unable to meet in person, we’ll go over how and when to mail your passport. In most cases, it’s returned by mail within 2 business days.

Review Documents

After your ITIN Package is prepared, we’ll send you a complete copy for review. If living domestically, we’ll mail you a copy for pen-to-paper edits. If abroad, we’ll upload a scanned copy to our client portal where your edits can be annotated digitally.

Mail ITIN Package

Once your documents are finalized, we’ll prepare the ITIN application package for submission and mail it to you. Once you receive it, just sign where indicated enclosed in the pre-addressed envelope provided, and take them to your local USPS or mail courier.

After mailing your signed documents, the IRS will process your ITIN package and notify us if any issues arise.
